THE ADU AMNESTY LAW” AB 2533

Beginning January 1, 2025, AB 2533 made it possible for homeowners of non-permitted living spaces to convert those same living spaces in to legal ADUs or JADUs.

AB 2533 is now known as "The ADU Amnesty Law" which prohibits denial of a permit for ADUs and JADUs existing before 1/1/2020.

This same law prohibits penalizing applicants for having unpermitted living spaces and avoid Code Enforcement Violations that may have been enforceable before 1/1/2020.

AB 2533 also prohibits impact or connection fees for unpermitted units (with exceptions due to unit size and other factors), and requires local agencies to inform the public about "substandard" quality of life conditions.

This law is significant in high density areas where space for new housing is limited and where property owners are incentivized to create more housing inventory.
